When taking on a lease in a commercial property, a Schedule of Condition is a beneficial tool to record the condition of the premises. Repair clauses of leases usually put the onus on the Tenant to effect repairs during the Tenant’s occupancy. The Schedule of Condition can be appended to a Lease to agree that inherent defects existing before the commencement of the Lease are not required to be repaired by the Tenant. When terminating a Lease the Schedule of Condition is then used as a reference point for negotiating the Schedule of Dilapidations, what is required to be repairs, and what is not?! Hopefully clearly defined as to what actions are required by either party of the Lease.
